General terms of sale and use of the Web site

1. PURPOSE
The company CAP EQUILIBRE proposes a service of remote sale of personalized astrological studies, on-line consultation relating to horoscopes, astrology, tarology, numerology and divinatory arts, (hereafter collectively named as the "Products"). The on-line order products belonging to CAP EQUILIBRE or any of its partners implies the general acceptance of the customer (hereafter named as the "Customer") of these General terms of Sale, which the Customer has read beforehand.

Particular terms can supplement the present General terms of Sale. The Customer will be informed via the Web site before any transaction takes place.

2. COMPULSORY CONDITIONS TO PLACE AN ORDER
To place orders on the Web site, the Customer, must be at least 18 years old, and therefore subject to contractual law, and use the Web site in accordance with the present general terms. The Customer also guarantees the veracity and the exactitude of information, which they provide.

3. APPLICABLE LAW
Parties agree that the contract concluded with the Customer is subject to French Law.

4. TRANSACTION PROCESS
The on-line order process includes of the following stages:
- the Customer selects the Product of their choice;
- a description of the Product and its cost is displayed;
- the Customer is invited to accept the present General Terms of Sale by ticking the box designed for this purpose;
- the Customer chooses their method of payment;
- the Customer is invited to provide their name and address unless they choose a method of payment preserving their anonymity. The compulsory information required is indicated by an asterisk;
- Once the payment is validated, the Customer gains access to the Product.

5. ORDER VALIDATION
The order placed by the Customer will be regarded as validated only when the payment authorization centers concerned, give their agreement on the transaction considered. In the event of a refusal by any the aforesaid centers, the order will automatically be cancelled.

6. ORDER RECEIPT ACKNOWLEDGEMENT
The Customer will be able to access compulsory information relating to their orders by contacting CAP EQUILIBRE at the following email address: admin@capequilibre.com or its partner TELEMAQUE at the following email address: cat-admin@chat.telemaque.fr. The Customer will have to provide to CAP EQUILIBRE or TELEMAQUE their personal identification details, which are necessary to identify the orders placed by the Customer. For those orders completed anonymously, the Customer will be able to access compulsory information relating to their orders by contacting the service provider who acknowledged and received the anonymous payment.

7. TARIFFS AND METHOD OF PAYMENT
The prices of the Products are indicated in Euros, inclusive of all taxes. Any tax fluctuations will be automatically reflected in the price of the Products. The accepted methods of payment differ according to the selected Product. In general, methods of payment using a bank card, which can be utilized, are those bank cards listed on the Web site, payment by SMS, payment over the telephone, payment by Ticket Surfing, payment recorded on a France Telecom invoice, payment on an internet subscription invoice.

8. TRANSACTION SAFETY
The Web site is equipped with the on-line payment system SSL 3.0 (secure socket layer) which enables 128 bit encryption for the bankcard number of the Customer. Other methods of payment are secured by the operators concerned (France Telecom, Ticket Surfing, service providers of internet access, telephony operators).

9. CAUSE BEYOND CONTROL - FORCE MAJEURE
CAP EQUILIBRE and its partners cannot be held responsible for any unspecified failure linked to their contractual obligations in the event of a cause beyond their control, or unforeseen incident including, but without being limited to; war, catastrophes, fires, domestic or international strike, national or international failure or breakdown, and generally any event preventing the timely completion of orders. CAP EQUILIBRE and its partners cannot be held responsible for any problem, which could occur during secured transactions. This responsibility falls on the various organizations providing these services.

10. LIMITATIONS TO THE RIGHT OF RETRACTION
In accordance with Article L.121-20-2 of the ‘Code de la Consommation’ (code of consumption), the Customer is informed that the right of retraction cannot be exercised for any agreement relating to the supply of services, whose execution started before the end of the seven clear days deadline.

11. PERSONAL CONFIDENTIALITY AND DATA PROTECTION
Information communicated by the Customer to the Web site, enables CAP EQUILIBRE to process and complete their respective orders. In accordance with article 32 of the ‘Loi Informatique et Libertés’ (Data Processing and Freedom Law) dated 06 January 1978, compulsory information for CAP EQUILIBRE to process and complete orders, are highlighted by an asterisk on the pages of the Web site. Other required information, for which an answer is optional, is sought to facilitate improved understanding of the Customer’s needs and subsequent Product development. The processing of the Customer’s particulars is carried out by CAP EQUILIBRE, who is committed to ensuring a sufficient level of protection of the information provided to guarantee the privacy, freedom and basic rights of all customers. The Customer is informed that their banking data will be retained for 120 days, which is necessary for the prevention of fraudulent transactions. Furthermore, banking data is encrypted and strict safety measures are implemented for their benefit. In accordance with the Data Processing and Freedom Law, the Customer has a right of access, modification and suppression of the data, which relates to them (articles 38 to 40 of the Data Processing and Freedom Law dated 06 January 1978). The Customer will be able to oppose the processing of their personal information only for legitimate reasons. The Customer can exert their rights, by sending a letter to the person responsible for the data processing to CAP EQUILIBRE - LP 3144 - 03105 Montlucon cedex or by email to admin@capequilibre.com. Unless the Customer clearly states their opposition, CAP EQUILIBRE and its partners will consider themselves free to send them, by mail and/or by electronic mail and/or telephone, offers of Products and services, messages of an advertising nature together with information on Products and services proposed by CAP EQUILIBRE and its partners.

12. INTELLECTUAL PROPERTY PROTECTION
All the contents of the Web site and all the rights of intellectual ownership relating to it, are the property of CAP EQUILIBRE and if necessary, of the company publishing the site. No right is given to The Customer with regard to the contents or the intellectual ownership of the Web site.

All installation of hypertext links to the Web site must be the subject of prior written agreement from CAP EQUILIBRE. Any unauthorized use of whole or part of the contents of the Web site and rights of intellectual ownership relating to it, will be subject to legal proceedings.

13. WEB SITE USE
CAP EQUILIBRE is not responsible if the Customer cannot access the Web site, particularly in the event of site maintenance, or if the access is blocked, at whatever time, or if an unspecified fault, independent of its intent, prevents any operation to be completed. CAP EQUILIBRE does not guarantee that the Web site is free from information technology viruses nor any other anomaly independent of its will.

14. COOKIE INSTALLATION
Definition of a cookie: includes information relating to the navigation habits of a internet visitor.

CAP EQUILIBRE or its partners want to install a cookie in the computer of the Customer. A cookie does not allow CAP EQUILIBRE or its partner to identify the Customer; on the other hand, it does record navigation information of the Customer on the Web site (pages the Customer consulted, date and time of access, etc.), which CAP EQUILIBRE or its partners will be able to read at the time of their subsequent visits. This information will be retained on the Customer’s computer for 10 years.

CAP EQUILIBRE informs the Customer that they can oppose the recording of "cookies" by configuring their navigator in the following way:
